These Seller Terms & Conditions ("Seller Terms") govern the onboarding, listing, and sale of products by sellers ("Seller", "you", "your") on the website https://autobestfixit.com/ ("Website") operated by AutoBest Fixit ("Company", "we", "us", "our"). These Seller Terms are in addition to the Terms & Conditions of Use, Buyers Terms & Conditions, and other policies published on the Website.

1. Scope & Applicability

These Seller Terms apply to all manufacturers, distributors, wholesalers, retailers, and other entities listing or selling products through the Website.

By registering as a seller or listing products, the Seller agrees to comply with these Seller Terms and all other applicable policies published on the Website.

2. Seller Eligibility & Onboarding

  • Sellers must be legally registered entities or individuals authorised to conduct business in India.

  • Sellers must provide accurate business details, tax registrations (including GST where applicable), bank details, and supporting documentation during onboarding.

  • AutoBest Fixit reserves the right to approve, reject, suspend, or terminate seller accounts at its sole discretion without assigning reasons.

3. Product Listings & Content

  • Sellers are solely responsible for the accuracy of product descriptions, images, specifications, compatibility data, pricing, and availability.

  • Product listings must not be misleading, inaccurate, or infringe any third-party intellectual property rights.

  • AutoBest Fixit reserves the right to modify, suspend, or remove listings that violate platform policies or applicable laws, without prior notice.

4. Pricing, Taxes & Invoicing

  • Sellers are responsible for determining product prices and ensuring compliance with all applicable tax laws including GST.

  • All prices must clearly indicate applicable taxes as required by law.

  • Sellers are solely responsible for issuing valid GST-compliant tax invoices to buyers for all transactions.

5. Order Fulfilment & Shipping

  • Sellers must process and dispatch orders within the agreed timelines.

  • Packaging must be secure and suitable for the safe transport of automobile spare parts.

  • Sellers are solely responsible for damages arising due to improper packaging, inadequate labelling, or delayed dispatch.

6. Quality Standards & Authenticity

  • Sellers warrant that all products listed and sold are genuine, authentic, new, and fit for sale unless explicitly disclosed otherwise.

  • Sale of counterfeit, refurbished (unless clearly disclosed at the time of listing), stolen, or illegal products is strictly prohibited and may result in immediate termination and legal action.

  • AutoBest Fixit reserves the right to conduct quality audits or request supporting documentation to verify product authenticity at any time.

7. Returns, Refunds & Replacements

  • Sellers must comply with AutoBest Fixit's Returns & Refund Policy as published on the Website.

  • Sellers may be required to accept returns or provide replacements in cases of defective, damaged, or incorrectly dispatched products.

  • Refund liabilities attributable to seller fault may be adjusted against seller payouts at AutoBest Fixit's discretion.

8. Payments & Settlements

  • Seller payments will be settled as per the agreed commercial terms and settlement cycles communicated at the time of onboarding.

  • AutoBest Fixit may deduct applicable fees, commissions, taxes, penalties, or adjustments before settlement.

  • Sellers are responsible for maintaining accurate and up-to-date bank account details. AutoBest Fixit shall not be liable for failed payments due to incorrect bank information provided by the Seller.

9. Intellectual Property Rights

  • Sellers retain ownership of their trademarks, brand assets, and content but grant AutoBest Fixit a non-exclusive, royalty-free licence to use such content for platform operations, product listings, and marketing purposes.

  • Sellers must ensure that all listed content, images, and descriptions do not infringe any third-party intellectual property rights.

  • Any claims arising from intellectual property infringement by a Seller shall be the sole responsibility of that Seller.

10. Compliance with Laws

  • Sellers must comply with all applicable central, state, and local laws, including but not limited to consumer protection, taxation, data protection, and product safety regulations.

  • Any regulatory non-compliance by a Seller shall be the sole responsibility of that Seller. AutoBest Fixit shall not be liable for such non-compliance.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • AutoBest Fixit shall not be liable for seller losses arising from buyer disputes, returns, chargebacks, or business interruption.

  • AutoBest Fixit does not guarantee any specific sales volume, revenue, or business performance for sellers on the platform.

  • Nothing in these Seller Terms limits or excludes any rights or remedies available under the Consumer Protection Act, 2019, or other applicable Indian law.

12. Indemnity

Sellers agree to indemnify and hold harmless AutoBest Fixit, its directors, employees, and partners from any claims, damages, losses, liabilities, or expenses (including legal costs) arising out of:

  • Breach of these Seller Terms

  • Sale of defective, counterfeit, or non-compliant products

  • Violation of third-party intellectual property rights or applicable laws

  • Any buyer disputes arising from seller error or negligence

13. Suspension & Termination

  • AutoBest Fixit may suspend or terminate seller access for violation of these Seller Terms, fraudulent activity, or non-compliance with applicable laws, with or without prior notice.

  • Upon termination, all pending obligations including returns, refunds, dispute resolution, and settlement of outstanding amounts shall survive and remain binding.

14. Confidentiality

Sellers agree to maintain strict confidentiality of all platform data, buyer information, pricing structures, and commercial terms shared by AutoBest Fixit. Sellers shall not misuse, share, or disclose such information to any third party without prior written consent.

15. Governing Law & Jurisdiction

These Seller Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in New Delhi.

16. Amendments

AutoBest Fixit reserves the right to modify these Seller Terms at any time. Updated terms will be effective upon publication on the Website. Continued use of the platform after such changes constitutes acceptance of the updated terms. Sellers are encouraged to review this page periodically.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, grievances may be submitted in writing to:

These Seller Terms are governed by Indian law and comply with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.
