These Seller Terms & Conditions ("Seller Terms") govern the onboarding, listing, and sale of products by sellers ("Seller", "you", "your") on the website https://autobestfixit.com/ ("Website") operated by AutoBest Fixit ("Company", "we", "us", "our"). These Seller Terms are in addition to the Terms & Conditions of Use, Buyer Terms & Conditions, and other policies published on the Website.

1. Scope & Applicability

  • These Seller Terms apply to all manufacturers, distributors, wholesalers, retailers, and other entities listing or selling products through the Website.

  • By registering as a seller or listing products, the seller agrees to comply with these seller terms and all applicable policies.

2. Seller Eligibility & Onboarding

  • Sellers must be legally registered entities or individuals authorised to conduct business in India.

  • Sellers must provide accurate business details, tax registrations (including GST where applicable), bank details, and supporting documentation.

  • AutoBest Fixit reserves the right to approve, reject, suspend, or terminate seller accounts at its sole discretion.

3. Product Listings & Content

  • Sellers are responsible for the accuracy of product descriptions, images, specifications, compatibility data, pricing, and availability.

  • Product listings must not be misleading, inaccurate, or infringe third-party intellectual property rights.

  • AutoBest Fixit reserves the right to modify, suspend, or remove listings that violate policies or applicable laws.

4. Pricing, Taxes & Invoicing

  • Sellers are responsible for determining product prices and ensuring compliance with applicable tax laws.

  • All prices must clearly indicate applicable taxes as required by law.

  • Sellers are solely responsible for issuing valid tax invoices to buyers.

5. Order Fulfilment & Shipping

  • Sellers must process and dispatch orders within the agreed timelines.

  • Packaging must be secure and suitable for automobile spare parts.

  • Sellers are responsible for damages arising due to improper packaging or delayed dispatch.

6. Quality Standards & Authenticity

  • Sellers warrant that all products sold are genuine, authentic, and fit for sale.

  • Sale of counterfeit, refurbished (unless disclosed), or illegal products is strictly prohibited.

  • AutoBest Fixit reserves the right to conduct quality audits or request supporting documentation.

7. Returns, Refunds & Replacements

  • Sellers must comply with AutoBest Fixit’s Returns & Refund Policy.

  • Sellers may be required to accept returns or provide replacements in case of defective, damaged, or incorrect products.

  • Refund liabilities attributable to seller fault may be adjusted against seller payouts.

8. Payments & Settlements

  • Seller payments will be settled as per agreed commercial terms and settlement cycles.

  • AutoBest Fixit may deduct applicable fees, commissions, taxes, penalties, or adjustments before settlement.

  • Sellers are responsible for maintaining accurate bank details.

9. Intellectual Property Rights

  • Sellers retain ownership of their trademarks and content but grant AutoBest Fixit a non-exclusive, royalty-free licence to use such content for platform operations and marketing.

  • Sellers must ensure that listed content does not infringe any intellectual property rights.

10. Compliance with Laws

  • Sellers must comply with all applicable central, state, and local laws, including consumer protection, taxation, and data protection laws.

  • Any regulatory non-compliance by a seller shall be the sole responsibility of the seller.

11. Limitation of Liability

To the maximum extent permitted by law:

  • AutoBest Fixit shall not be liable for seller losses arising from buyer disputes, returns, or business interruption.

  • AutoBest Fixit does not guarantee sales volume or business performance for sellers.

12. Indemnity

Sellers agree to indemnify and hold harmless AutoBest Fixit from any claims, damages, losses, liabilities, or expenses arising out of:

  • Breach of these Seller Terms

  • Sale of defective, counterfeit, or non-compliant products

  • Violation of third-party rights or applicable laws

13. Suspension & Termination

  • AutoBest Fixit may suspend or terminate seller access for violation of these seller terms or applicable laws.

  • Upon termination, pending obligations including returns, refunds, and dispute resolution shall survive.

14. Confidentiality

Sellers agree to maintain confidentiality of platform data, buyer information, and commercial terms and shall not misuse such information.

15. Governing Law & Jurisdiction

These Seller Terms shall be governed by and construed in accordance with the laws of India. Courts located in Delhi shall have exclusive jurisdiction.

16. Amendments

AutoBest Fixit reserves the right to modify these Seller Terms at any time. Updated terms will be effective upon publication on the website.
